The following general terms and conditions are provided to the customer by reddingtonservicesgmbh (hereinafter referred to as reddington) and shall become part of the contractual agreements:
Reddington shall issue a proper invoice. All prices for agency services are strictly net. When engaging artists through the agency, prices are subject to the social security contribution for artists (Künstlersozialabgabe) on artist fees in accordance with the rates specified by the Artists’ Social Security Fund (Künstlersozialkasse) and the statutory value-added tax to be paid in the Federal Republic of Germany, even if this should not be explicitly provided for in individual cases. Should value-added tax be payable to another governmental organization, Reddington shall be entitled to the payment of this tax. No discounts or cash discounts (Skonto) shall be granted.
Unless otherwise agreed, the total amount is payable without deductions as follows:
50% of the contract volume upon conclusion of the contract
50% of the contract volume within 14 days after the end of the event.
Travel expenses and per diems for personnel commissioned by Reddington shall—unless otherwise agreed—be billed based on actual expenditure. Flights within Europe as well as intercontinental flights shall be booked in Economy Class. Rail travel shall be in 2nd class.
Travel expenses and per diems for Reddington agency employees shall—unless otherwise agreed—be billed based on actual expenditure. Flights within Europe shall be booked in Economy Class, intercontinental flights in Business Class. Rail travel under 350 km shall be in 2nd class, journeys exceeding this distance shall be in 1st class.
Travel expenses and per diems for the Reddington executive management shall—unless otherwise agreed—be billed based on actual expenditure. Flights within Europe shall be booked in Business Class, intercontinental flights likewise. Rail travel shall be in 1st class.
All expenses and outlays incurred by Reddington that are not to be covered according to Reddington’s service description shall be billed based on actual expenditure plus a handling fee of 15%.
All services not included in the service description must be additionally remunerated by the customer, even if Reddington does not rely on third-party services but has the respective service executed by its own employees. Reddington is entitled to execute work, which Reddington could outsource to third parties in the name and for the account of the customer, through its own employees and subsequently bill the customer separately for it.
Reddington is entitled to charge reminder fees and standard bank default interest in the event of default of payment. Any arising GEMA fees, as well as energy, water, and waste disposal costs, shall be borne by the customer.
Unless otherwise agreed, the invoice amount is payable within 14 days of the invoice date. Default interest shall be calculated at a rate of 8% above the respective base interest rate per annum. The right to assert higher damages caused by default remains reserved.
Cancellation by the customer up to 90 days before the originally scheduled date: against reimbursement of the project costs incurred, including third-party service providers.
Cancellation by the customer up to 45 days before the originally scheduled date: 50% of the confirmed contract volume.
Cancellation by the customer from 30 days before the originally scheduled date: 100% of the confirmed contract volume.
